The present complaint is being filed by the Petitioner under Section 142 of the Electricity Act, 2003, against the Respondent for non-compliance of the Chhattisgarh State Electricity Supply Code-2011, whereby the Honble Commission had made rules with respect to distribution and supply of electricity and the procedures thereofIt is stated that the Corporate Ispat Alloys Limited CIAL subsequently got merged with the Petitioner required regular 220 KV power supply and accordingly CIAL applied for the same to the Chhattisgarh State Electricity Board CSEB Erstwhile Entity of the Respondent vide its letter dated 3042007That, subsequently on 11042007, the Respondent in response to the application by the CIAL, issued a communication wherein the Respondent provided an estimated expenditure of Rs 6,86,91,000-for construction of 6 KM DCSS Line and 220 KV BayThat, CIAL, in accordance with the draft estimates provided by the Respondent paid an amount of Rs 8,27,98,000,00- Rs 6,86,91,000- along with the Security Deposit of Rs 1,41,07,000 for construction of the 6KM 220 KV DCSS Line, from Siltara Substation and 220 KV BaySubsequently, CIAL through its communication dated 14102008, also requested the Respondent to install dedicated 220 KV metering arrangement at 220 KV SS Urla, for metering of import of power by CSEB from CIAL and also requested to provide an estimated cost for the above said workThat, in Pursuance of the request for providing dedicated 220 KV metering arrangement at 220 KV SS Urla, for metering of import of power by CSEB from CIAL, the Respondent furnished the estimates vide its communication dated 27112008 The Respondent provided an estimated expenditure of Rs 45,40,600- That, CIAL deposited an amount of Rs 45,40,600-, with CSEB in two tranches of Rs 44,69,100- and Rs 71,541- on 12112008 and on 31122008 respectivelyHowever, the Respondent, after receipt of payment from the CIAL, issued a communication dated 13042009, informing that the dedicated 220 KV metering equipment was not available and instructed CIAL to procure the same equipment on its own cost from open marketThat, the Petitioner procured the metering equipment at its own cost and provided the same to the Respondent That, the Petitioner vide its letter dated 06082009, requested the Respondent, to refund the amount of Rs 32,36750- deposited by the Petitioner towards procurement of the said metering equipmentThat, even after the issuance of the aforesaid communication, the Respondent miserably failed to refund the amount of Rs 32,36,750- deposited by CIAL, towards procurement of the metering equipmentThat, on 17022011, CIAL once again wrote a communication to the Respondent demanding the refund of the amount towards procurement of the metering equipment Meanwhile, pending the clearance of refund, unit of CIAL, was merged with Jayaswal Neco Industries Limited, pursuant to a Scheme of Compromise and Arrangement sanctioned by the Honble Bombay High Court, Nagpur Bench, Nagpur, vide order dated 13112009 in Company Petition No 102009That, subsequently after a lapse of more than 4 years, the Respondent vide its letter dated 16122015, requested its Executive Director, to look into the Request of the Petitioner Even after the issuance of the aforesaid communication, the Respondent did not take any positive steps to refund the amount deposited by the CIAL towards procurement of metering equipment to the instant PetitionerThat, after a constant follow up by the Petitioner, the Respondent vide its letter dated 24012018, determined the final estimated expenditure in connection with the completion of the DCSS 6 KM Line, 220 KV Bay and instructed its relevant authority to initiate a refund of Rs 1,84,05,542- However, the concerned authority took into consideration an amount of Rs 6,72,47,000- as the deposited amount, whereas the actual amount deposited by the CIAL was 6,86,91,000 Thus, an amount of Rs 14,44,000- was still not refunded by the Respondent to the PetitionerThat, since an amount of Rs 46,80,750- Rs32,36,750-Rs14,44,000- was still lying with the Respondent, the Petitioner during the year 2018-2019 issued various communications to the Respondent to look into the matter and refund the required amount However, the Respondent paid no heed to the repeated requests by the PetitionerDue to the constant ignorance by the Respondent, the Petitioner was forced to issue legal Notice through its Counsel calling upon the Respondent to pay an amount of Rs 1,76,13,952- Principal Amount of Rs 59,84,600- along with the interest of Rs 1,16,29,352- calculated 1 PM After the receipt of the Legal Notice, the Respondent only with an intention to delay the process of refund to the Petitioner, has issued a communication dated 06022020, whereby it has asked the Petitioner to deposit the original money receipt of the amount deposited by the Petitioner towards the metering equipment It is pertinent to state that the said money receipt
